1. Introduction and About Us

These Terms and Conditions ("Terms") govern your use of the websites located at www.montysbeads.com and www.montysjewellery.com (the "Sites") and your relationship with Monty’s Devon Ltd ("we", "us", or "our").

Please read these Terms carefully before using our Sites or placing an order. By accessing our Sites or purchasing goods, you agree to be bound by these Terms.

2. Orders and Contract Formation

2.1. All orders are subject to acceptance and availability.

2.2. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email is an acknowledgement and does not constitute acceptance of your order.

2.3. A contract between us for the purchase of the goods will not be formed until your payment has been approved and we have debited your credit or debit card.

2.4. We reserve the right to reject an order for any reason, including but not limited to: the item being out of stock; a pricing or product description error; or an inability to obtain authorisation for your payment.

3. Product Descriptions and Pricing

3.1. Pricing: All prices displayed on the Sites are in British Pounds Sterling (£) and include VAT where applicable.

3.2. Errors: While we endeavour to ensure that all details, descriptions, and prices on the Sites are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled.

3.3. Availability: If an item you have ordered is out of stock, we will contact you to offer a replacement or a full refund.

3.4. Diamond Weights: The term "TDW" refers to Total Diamond Weight, representing the combined weight of all diamonds within a piece of jewellery.

3.5. Certificates: If a product includes a grading certificate (e.g., GIA), this is the original document. We cannot replace lost reports; please keep them safe.

4. Payment and Security

4.1. We take your security seriously. We utilise Secure Sockets Layer (SSL) technology to encrypt your personal information during transactions.

4.2. Payment must be made by the methods indicated on the Sites. You confirm that the credit/debit card being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it.

5. Shipping and Delivery

5.1. Delivery times are estimates only. Monty’s Devon Ltd shall not be liable for any delay in delivery of the goods howsoever caused.

5.2. You are responsible for providing a correct and safe delivery address. A signature may be required upon receipt.

5.3. If you are not available to accept delivery, the courier may leave a calling card with instructions for re-delivery or collection.

5.4. Ownership of the products passes to you upon delivery, provided full payment has been received. Risk of loss or damage passes to you at the time of delivery.

6. Right to Cancel (Consumer Contracts Regulations 2013)

6.1. Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods without giving any reason.

6.2. How to Cancel: To exercise this right, you must notify us immediately via email or our contact form.

6.3. Returns: You must send the goods back to us at the address listed in Section 1 no later than 14 days from the day on which you communicated your cancellation.

6.4. Costs: You will have to bear the direct cost of returning the goods. We recommend using a recorded delivery service and retaining proof of postage.

6.5. Refunds: We will reimburse you no later than 14 days after the day we receive the goods back from you. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

7. Exceptions to Cancellation and Returns

We are unable to accept returns or cancellations for the following items unless they are faulty:

• Earrings: For hygiene reasons, earrings cannot be returned.
• Bespoke/Personalised Items: Goods that are made to your specifications or clearly personalised.

8. Special Orders and Custom Services

8.1. Commitment: Orders for custom-made jewellery, special orders, or repair services are binding once work has commenced or materials have been ordered.

8.2. Cancellation Fee: If you wish to cancel a bespoke order before completion, acceptance of the cancellation is at our sole discretion. If accepted, you will be liable for a cancellation fee of 30% of the total order value to cover costs incurred.

8.3. Completion: If the work has already been completed, you are liable for the full cost.

9. Faulty Goods (Consumer Rights Act 2015)

9.1. We are under a legal duty to supply goods that are in conformity with this contract.

9.2. If your goods are faulty, as described, or not fit for purpose:

• Within 30 days: You can reject the item for a full refund.
• Up to 6 months: We will repair or replace the item. If we cannot, you may be entitled to a full or partial refund.

9.3. Limited Warranty: In addition to your statutory rights, we offer a 12-month warranty against defects in workmanship and materials. This excludes damage caused by wear and tear, accidental damage, misuse, or unauthorised alterations (including resizing by third parties).

10. Data Protection and Privacy (GDPR)

10.1. Data Controller: Monty’s Devon Ltd is the Data Controller for your personal information.

10.2. Collection: We collect personal data (Name, Address, Email, Payment Details) necessary to process your order, deliver goods, and meet legal obligations.

10.3. Legal Basis: Our lawful basis for processing this data is the performance of a contract (fulfilling your order) and legitimate business interests.

10.4. Your Rights: Under the UK GDPR, you have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request erasure of your data ("Right to be Forgotten"), subject to legal tax retention requirements.
• Object to direct marketing.

10.5. Marketing: We will only send you marketing communications if you have explicitly opted in. You may unsubscribe at any time.

10.6. Cookies: We use cookies to improve your experience on our Sites and for analytics (e.g., Google Analytics). You can adjust your browser settings to refuse cookies, though this may limit site functionality.

11. Limitation of Liability

11.1. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11.2. Subject to clause 11.1, Monty’s Devon Ltd shall not be liable for any indirect or consequential loss, loss of profit, or loss of business arising out of or in connection with these Terms.

12. Jewellery Cleaning and Repairs

We reserve the right to refuse to clean, polish, or repair items at our discretion if we believe the item is too fragile or if there is a risk of damage during the process.

13. Complaints

If you have a complaint, please contact us via our website form or visit our Exeter shop. We aim to acknowledge complaints within 2 working days and will keep you informed throughout the resolution process.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
